Missouri Supreme Courts Recognizes Public Employees' Right to Bring Lawsuit for Damages When Fired for Exercising Work Comp Rights

The Missouri Supreme Court has recognized that public employees working for municipalities, school districts, counties, and numerous other public entities have a right to pursue damages against their employer when they are fired for exercising work comp rights. Though this right has existed since 1974 for employees of businesses, four prior Court of Appeals decision had been read as denying the right to public employees. We were able to get this erroneous interpretation of the law corrected, and tens of thousands of Missouri public employees finally are entitled to vindication! Kansas Court of Appeals Determines a Loss at Work Comp Preliminary Hearing Does Not Means a Loss in Civil Lawsuit

The Kansas Court of Appeals determined that a loss by an injured worker at a non-binding, non-appeal preliminary hearing does not prevent that employee from prevailing a subsequent wrongful discharge lawsuit. This was a hard-fought case that protects the workers of Kansas. Here are links to the opinion and the oral argument.

On September 20, 2021, Dan Doyle and Robert Bruce tried their first jury trial since the beginning of the COVID-19 pandemic !
